Service Description

The App is a mobile application that allows users to edit photos with prompts using AI-powered features. Key features include:

• Photo uploading and processing
• AI-powered prompt-based photo editing
• Image manipulation and generation
• Account synchronization for user progress and settings (no image data stored)

Age Restrictions and Minor Protection

Strict prohibition on modifying images of minors. You are expressly prohibited from uploading or processing any images depicting individuals under 18 years of age. Any inappropriate modification of photos containing minors is strictly forbidden. If you become aware that someone is using the app to process images of minors inappropriately, please contact us immediately at software@bigoen.com.

User Accounts and Security

The App utilizes an anonymous account system, typically linked to your device's unique identifier (e.g., Android ID) for progress tracking via Firebase Authentication. You are solely responsible for maintaining the security of your device and managing access to the App on your device. Since your account is tied to your device, transferring "account credentials" in the traditional sense is not applicable. Please immediately notify us at software@bigoen.com if you suspect unauthorized access or misuse of the App on your device.

User Responsibilities and Prohibited Content

You agree to:

• Use the App only for lawful purposes
• Obtain explicit written consent from any identifiable person appearing in uploaded images before processing such images through our AI system
• Ensure you have secured all necessary permissions from individuals depicted in any uploaded content
• Not upload malicious files or harmful content
• Not reverse engineer, decompile, modify, or create derivative works from the App
• Respect third-party rights, including privacy, intellectual property, and copyrights
• Avoid disrupting or interfering with the App's services or servers

Strictly Prohibited Content

You are expressly prohibited from uploading, creating, generating, or distributing:

• Any content depicting minors (anyone under 18 years of age)
• Sexually explicit content or nudity
• Non-consensual intimate imagery or "revenge porn"
• Deepfakes or AI-generated content depicting real persons without their explicit written consent
• Content that impersonates others or violates privacy rights
• Content depicting violence, harassment, or illegal activities
• Copyrighted material without proper authorization
• Content that violates any person's publicity or personality rights

Consent and Biometric Data Processing

By uploading images containing identifiable persons, you consent to the processing of the image data (including facial features) necessary for the App's AI-powered editing and transformation features. This processing is solely for the purpose of providing the App's core functionality and is not for biometric identification or authentication. You represent and warrant that:

• You have obtained all necessary consents from individuals depicted in uploaded images
• You have the legal right to process and share all uploaded content
• No uploaded content violates any person's privacy, publicity, or other legal rights

Content and Intellectual Property

Your Content

You retain ownership of the content you upload or create using the App. By uploading content, you grant the App a limited, non-exclusive license to process your content solely to provide and improve the App's services. You must ensure you have all rights necessary to upload and share content, including model releases and consent forms for any identifiable persons.

AI-Generated Content

You acknowledge that AI-generated outputs may inadvertently resemble existing copyrighted works or real persons. You bear full responsibility for ensuring your use of generated content does not infringe third-party rights. Subject to compliance with these Terms, you retain ownership of AI-generated content you create, but you grant us a perpetual, worldwide, royalty-free license to use your inputs and outputs for service improvement, legal compliance, and content moderation purposes.

Our Content

The App and all its features are owned by the App provider and protected by intellectual property laws. You may not copy, modify, distribute, or reproduce the App or its content without explicit permission.

Content Moderation and Enforcement

We employ both automated and human moderation systems to detect prohibited content. We reserve the right to:

• Monitor, review, and remove any content that violates these Terms
• Suspend or terminate accounts for violations without prior notice
• Report illegal content to appropriate authorities
• Cooperate with law enforcement investigations

Violation of content policies, particularly those involving minors, non-consensual content, or deepfakes, may result in immediate account termination and potential legal action.

User Liability and Responsibility

You are solely responsible for your use of AI-generated content and any legal consequences arising from such use. You acknowledge that:

• AI-generated content may pose legal risks including copyright infringement, privacy violations, or defamation claims
• You use the service at your own risk
• You must conduct appropriate legal due diligence before using AI-generated content commercially or publicly

Subscription and Payments

The App may offer free and premium features. Premium features require payment via Apple App Store or Google Play Store. Subscription terms, payments, and refund policies are governed by the respective store policies. Usage data may be shared in accordance with our Privacy Policy.

Third-Party Services

The App integrates with third-party services including Firebase (Authentication, Firestore, Storage), RevenueCat (subscription management), OpenAI, Google, Replicate.com, FalAI, Apple App Store, and Google Play Store. Your use of these third-party services is subject to their respective terms and privacy policies.

Reporting Violations

Users can report content violations or suspected illegal activity through our designated reporting system at software@bigoen.com. We will investigate reports promptly and take appropriate action, including content removal and account suspension. We maintain procedures for responding to legal notices and law enforcement requests.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that AI-generated content will be free from potential legal issues, copyright infringement, or privacy violations. We do not guarantee error-free operation, accurate results, or that the App will meet your expectations.

Limitation of Liability

While we implement safeguards, we cannot guarantee that AI-generated content will be legally compliant in all jurisdictions. The App provider is not liable for indirect, incidental, consequential damages, or loss of profits/data. Our total liability is limited to the amount you have paid for the App in the past 12 months.

Indemnification

You agree to indemnify the App provider and its affiliates against any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the App and AI-generated content
• Copyright infringement, privacy violations, defamation, or other legal claims related to your content
• Creating or distributing non-consensual content or deepfakes
• Violation of third-party rights

Termination

The App provider reserves the right to terminate or suspend your access to the App for any violations of these Terms, including but not limited to: uploading prohibited content, copyright infringement, creating non-consensual content, or any activity involving minors or that poses legal risks to our platform or users. You may stop using the App at any time. Sections concerning intellectual property, liability, indemnification, and governing law will survive termination.

Changes to Terms

We may modify these Terms periodically to address evolving legal requirements, particularly in AI and privacy law. Changes will be communicated by updating the "Last Updated" date above and may be accompanied by in-app notifications. Continued use of the App following changes indicates acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws applicable in the jurisdiction where the App operates, without regard to conflict of law provisions.
